Is Delta-9 legal to buy and use in Georgia?

Recreational marijuana remains illegal here in Georgia. But what about Delta-9, an intoxicating form of THC that, through the passage of the 2018 Farm Bill legalizing the sale of hemp and hemp-derived products, is legal in some states?

The Georgia laws addressing the legal status of hemp-derived Delta-9 products are currently in flux, but appear to focus mainly on the packaging and potency rather than the actual legality of the product itself. Read on to learn more about the legalities of these products.

Why there are apparent problems

With the bills most recently introduced in Georgia to deal with the sales of Delta-9 products, lawmakers expressed concern that these products were packaged and marketed to appeal to underage children more than adults. Moreover, some varieties of the products contained elements of children’s candy, e.g., Nerd-studded Delta-9 gummies that a child could easily confuse for a tasty treat.

How could this affect Delta-9 buyers?

If you purchased a hemp-infused product like Delta-9 flower or even gummies that were out of their original container, a police officer could misinterpret the substance for illegal marijuana or THC gummies manufactured in states where they are legal.

Even if you are later exonerated in court, simply being arrested on a drug charge can be enough to derail a productive life. In some professions, it could be enough to bar you from future employment or even get you fired from your present job.

Take charge of your future by being proactive about your defense to any drug charges. Invoke your right to remain silent until you have had time to devise your legal strategy to fight these allegations.
